Terms and Conditions for Usage of Rose International’s RFriends Candidate Portal

  1. User must complete registration process to gain access to the RFriends Candidate Portal system.
  2. User must agree to the Rose International RFriends terms and conditions statement to complete registration process.
  3. Rose International’s RFriends Candidate Portal System reserves the right at any time to modify or discontinue the Program either temporarily or permanently with or without notice. You agree that Rose International shall not be liable for you or any modification, suspension or discontinuance of the Program. Rose International may change, add or remove any part of this Agreement, or any other terms associated with the use of the site, at any time, by posting a notice of such changes to the Terms of Use page within the Program. Any changes shall become part of the Agreement, and shall apply as soon as that notice is posted. By continuing to use the Rose International RFriends Candidate Portal after the notice is posted, you are indicating your acceptance of those changes.
  4. All qualified referrals must be referred thru the RFriends System in order to qualify for commission on a referral once placed on a project with a client.
    1. Qualified referrals are: (1) New candidate referrals, not currently in the Rose International database; (2) Any candidate currently listed in the Rose International database with a status of "Inactive".
    2. Referrals not considered qualified as RFriends Referrals: (1) Any candidate currently listed in the Rose International database with a status other than "Inactive"; (2) Duplicate entries of candidates using alternate information such as name, phone or e-mail address, that is not currently used in the existing candidate profile in the Rose International database, where the candidate has a status other than "Inactive" . (3) Self-Referrals.
    3. Each referral can be submitted to a maximum of ten (10) positions each week. This also includes self referrals.
    4. Referral commission cannot be paid for the following: (1) Candidates referred for internal Rose positions, as they are not billable to a client; (2) Candidates found and presented to Rose directly from the client, otherwise known as Payrolling/Pass-through candidates. (3) Self-Referrals.
  5. Commission will be paid to the registered RFriend for each RFriends Referral successfully placed with a client through Rose International using the RFriends system.
    1. Commission is based on the number of hours worked by the referred candidate.
    2. Commission is paid on the 26th of each month for the previous month’s hours worked.
    3. Commission will be paid to the referring party for the duration of the assignment, and will terminate upon termination of the referred candidate and/or project completion.
  6. Registration Status for Registered RFriends – All new registrations will be “Active” and have access to the RFriends System for an initial period of 90 days.
    1. Registered RFriends users can notify the RFriends Administrator to stop all communication and contact.
    2. Registered RFriends users can change the communication preferences of their profile at anytime.
    3. Continuing Active Registration Status requires:
      1. Registered RFriend to refer a new friend ("referral") or tie an existing friend to an opening every 90 days. After the initial 90 day period, if no activity, the Registered RFriend status will be changed from "Active" to "Inactive", which will deactivate access to the RFriends System.
      2. Registered RFriend has referred candidates placed and billing through the RFriends System. Status will stay “Active” for duration of time where referred candidates are billing. Once there are no RFriend referrals currently billing, the 90 day rule will then apply.
    4. If access is deactivated, Registered RFriend will need to contact the RFriends Administrator to reactivate the account/access. A new temporary password will be assigned at that time. Once reactivated, the 90 day rule will again apply.
  7. Rose International reserves the right to withdraw, either temporarily or permanently, the program at any time without notice. Should the program be discontinued, any in-process referrals will be handled per then RFriends program rules for a transition period of 90 days while no new referrals are accepted and in process referrals work through the placement process. Rose International also reserves the right to deny payment to any person suspected of abusing the program.
  8. Your relationship to Rose International is one of an independent contractor. No employee-employer relationship is created by your use of the RFriends Candidate Portal System. You are fully responsible for filing Local, State or Federal or any other taxes, if applicable on any compensation received as a result of your participation in the RFriends Referral Program. Upon placement of your first referral, Rose International will request your Social Security Number and other appropriate tax-related information to use to comply with Federal and State tax regulations.
